2. Service Description

Nature of the Service

0am provides a client-side encryption framework that allows you to encrypt and store data securely in our associated cloud library. Although geared toward B2B scenarios, individuals may also use the Service, subject to any payment-partner restrictions.

Intended Usage

The Service supports secure data storage and encryption solutions for various websites and applications. We do not limit or monitor how clients use the Service, but reserve the right to suspend or block accounts that create legal, financial, or reputational risks or harm our infrastructure.

No Warranty Against Misuse

We are not responsible for your or your end-users’ actions on the platform. Problematic or harmful activity may lead to account restrictions or termination.

3. Account Creation & User Responsibilities

Age Requirements

No explicit minimum age is set; you must comply with any age-related restrictions of our payment processor (Stripe).

Account Security

You are fully responsible for safeguarding account credentials and encryption keys. Because 0am uses client-side encryption, we cannot access your plaintext data or passwords. We are not liable for data loss or unauthorized access arising from compromised credentials.

Prohibited Activities

  • Reverse-engineering or decompiling the Service except as permitted by law.
  • Reselling the Service or creating derivative commercial products without prior written consent.

Violations may result in immediate suspension or termination without refund.

4. Subscription Plans & Payment

Plan Options

Plans vary by storage, request limits, connected websites, and data transfer. Details are shown on our website or in your dashboard.

Billing Cycle

Stripe processes payments. Subscriptions renew automatically on a monthly or yearly basis. By subscribing, you authorize Stripe to charge your chosen payment method.

Accepted Payment Methods

Only Stripe-supported payment methods are accepted.

Free Tiers & Trial Modes

  • Localhost Free Tier — restricted to localhost; data purged after a defined period.
  • Sandbox Mode — shared environment where data is visible to all sandbox users and deleted after one week; not for production use.

Refund Policy

  • Full refund within 24 hours if no data uploaded or used.
  • Partial refund (at our discretion) if less than half the subscription period and limited usage.
  • No refund after half of the period or if the account is terminated for Terms violations.

5. Pricing Changes & Overages

Price Adjustments

At least 30 days’ notice is provided before fee changes via email, in-platform messages, or website announcements.

Overage Policies

Up to 10 % margin beyond plan limits is allowed to prevent sudden downtime. Beyond that, hard limits may apply. Upgrade your plan in advance if higher usage is expected.

6. Service Availability & Technical Requirements

“As-Is” Basis

The Service is provided on a best-effort basis with no guaranteed uptime.

Scheduled Maintenance

We aim to notify you at least one week before scheduled maintenance. During these windows the Service may be limited or unavailable.

Downtime Liability

We disclaim liability for interruptions, delays, or data loss caused by downtime.

7. Termination of Service

Termination by User

Cancel any time via the dashboard. Cancel before the renewal date to avoid the next charge.

Termination by Us

We may suspend or terminate your account for non-payment, Terms violations, or harm to our systems. Refunds for violations are not guaranteed.

Data Handling After Termination

You may export data before cancellation (subject to platform capabilities). After termination, your data will be deleted as soon as feasible.

8. Intellectual Property & Licenses

Our IP

We own all rights to 0am’s algorithms, technology, and branding. Nothing in these Terms transfers ownership.

User-Generated Data

Data you upload remains yours in encrypted form. You grant us a limited right to store, process, and transmit it as needed to provide the Service.

License to Use

We grant you a revocable, non-exclusive, non-transferable license to use our APIs, libraries, and cloud systems, conditioned on compliance with these Terms and payment of applicable fees.

9. Disclaimer & Limitation of Liability

Disclaimer of Warranties

The Service is provided “as is” and “as available”, with no warranties, express or implied.

Limitation of Liability

To the fullest extent permitted by Swiss law, our total liability for any claim shall not exceed the subscription fees paid for the current billing period. We are not liable for indirect or consequential damages.

10. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by Swiss law, without regard to conflict-of-law principles.

Dispute Resolution

We reserve the right to engage or decline mediation or negotiation. We disclaim liability for indirect or consequential losses as allowed by Swiss law.

11. Changes to the Terms

Notification of Updates

We may update these Terms from time to time. We will notify you through the website or other means before changes take effect.

Effective Date

Continuing to use the Service after updates become effective constitutes acceptance of the new Terms.

12. Additional Clauses

Third-Party Payment Provider

We use Stripe for payment processing and are not responsible for issues arising from Stripe’s services.

Privacy Policy

Use of the Service is also subject to our Privacy Policy, incorporated by reference.

No Data Processing Agreement (DPA)

We do not currently provide a DPA. Contact us if one is required to discuss potential options.
